# AI Home Desiginers Terms of Service

## Introduction
Thank you for choosing AI Home Desiginers as your go-to platform for AI image generation (the “Services”). These Terms of Service (the “Agreement”) detail the rights and obligations concerning the images and assets you generate through the Service, your use of the Services, and other critical matters, including dispute resolution. This Agreement is entered into by AI Home Desiginers Inc. and the entity or individual accepting these terms (the "Customer," “You” or “Your”), governing access to and usage of the Services.
This Agreement becomes effective when presented to the Customer, who proceeds to use the Services (the "Effective Date") or receive/distribute Assets. These terms may be periodically updated, and the Customer will be presented with the revised terms. Continued use of the Services indicates acceptance of the updated terms. If You disagree with this Agreement, please discontinue using the Services.
## 1. Service Availability and Quality
Your use of the Services is at your sole risk. We provide these Services on an “as is” and “as available” basis. We do not offer service-level agreements for most of our Services yet — but do take uptime of our applications seriously.
AI Home Desiginers reserves the right to suspend or ban Your access to the Services for any violations or highly excessive usage through automations. Reverse engineering of the Services or Assets is not allowed. Automated tools for accessing, interacting with, or generating Assets through the Services are prohibited. Only one user per registered account is permitted.
We retain the right to investigate complaints or reported violations of our Terms of Service and take appropriate action, including reporting suspected unlawful activity to relevant authorities and disclosing necessary information.
## 2. Age Requirements
By accessing the Services, You affirm that You are at least 13 years old and meet the minimum age of digital consent in Your country. If You are of age but lack the authority to consent to our terms, Your parent or guardian must agree on Your behalf.
If You are a parent or legal guardian allowing Your teenager to use the Services, these terms also apply to You, and You are responsible for Your teenager’s activity.
While AI Home Desiginers strives for PG-13 and family-friendly Services, note that Assets are generated by an AI system based on user queries, and outcomes may vary. No guarantees are made about the suitability of Assets for the Customer.
## 3. Your Information
By using the Services, You may provide AI Home Desiginers with personal information, such as Your email address, username, billing information, favorites, image outputs, and text prompts. Our privacy policy can be found [link to your privacy policy].
### Copyright and Content Ownership
- We claim no intellectual property rights over the material you provide to the Services. All materials uploaded remain yours.
- You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Services, use of the Services, or access to the Services without the express written permission by the Company.
- You must not modify another website so as to falsely imply that it is associated with the Services or the Company.
### Your Rights
Subject to the above license, You own all Assets created with the Services, provided they comply with this Agreement. Your ownership of Assets persists even if You downgrade or cancel Your membership. However, exceptions apply.
- If You are an employee or owner of a company with over $1,000,000 USD in annual gross revenue, and You use the Services on behalf of Your employer, an Enterprise membership for accessing the Services on Your behalf is required to own created Assets.
- If You are not a Paid Member, You don’t own the Assets You create. Instead, AI Home Desiginers grants You a license under the Creative Commons Noncommercial 4.0 Attribution International License (the “Asset License”). Note: AI Home Desiginers is an open community allowing others to use and remix Your images, prompts and uploaded models when posted in public settings. By default, Your images are publicly viewable and remixable. If You purchase private model uploads or have an Enterprise plan, your data and models will remain private.
## 4. Unlimited Service and Rate Limiting
If You purchase an unlimited shared plan, we aim to provide unlimited access. However, we reserve the right to rate limit to prevent quality decay or interruptions for other customers. However, if you purchase an Enterprise plan, there will be no rate limiter.
## 5. Payment and Billing
We may invoice You through a third-party payment service provider. The provider’s terms govern and supersede this Agreement in case of conflict.
You may choose between one time-payment or monthly subscriptions. The prices and differences between subscription plans are described on our webpage.
For upgrades or downgrades in plan level, the new rate starts from the next billing cycle. When you upgrade in the middle of the monthly subscription, you will be charged proportionally to the time left to the end of the current subscription term.
You may cancel Your plan at any time. We reserve the right to terminate Your access for any reason, including Community Guidelines violations. Violations constitute a breach with no refunds for the current period.
## 6. Community Guidelines
Be kind and respectful. Avoid creating disrespectful, aggressive, or abusive content. Violence or harassment is not tolerated.
No adult content or gore; avoid visually shocking or disturbing content.
Do not use the Services for political campaigns or election influence.
Violations may lead to service bans. The Service is not a democracy; respectful behavior is required.
## 7. Limitation of Liability and Indemnity
The Service is provided as is, with no promises or guarantees.
We are not liable for the loss of profits, goodwill, or data. No liability for incidental, indirect, special, consequential, or exemplary damages.
You are responsible for Your use of the service. We are not involved in disputes or harm resulting from Your actions.
You are responsible for all content posted and activity that occurs under your account. That includes content posted by others who either: (a) have access to your login credentials; or (b) have their own logins under your account.
Knowingly infringing on someone else’s intellectual property, leading to costs, may result in legal action. You may be required to pay damages and attorney’s fees.
Refund Policy
Effective Date: December 7, 2023
Thank you for your interest in our products and services. We offer a 24-hour satisfaction guarantee, allowing full refunds for any purchases made within 24 hours of purchase.
Conditions for Refund:
- To be eligible for a refund, you must request it within 24 hours of your purchase.
- You must provide a valid reason for your refund request.
- Private models uploads and training credits must be unused to be eligible for refunds.
- Services rendered are not eligible for refunds once completed.
Refund Process:
To request a refund, please contact support via chat or mail us at hello@aihomedesigners.com within 24 hours of your purchase. Please provide your registered email address and the reason for your request.
We will review your request and will issue a full refund if it meets the conditions outlined above. Refunds will be processed within 5-7 business days.
